1. General Booking Conditions
Making a booking through web sites owned by BELLART CARDOS SL means that the client or user of the pages expressly accepts these conditions as well as the terms of use established for navigation on pages that pertain to BELLART CARDOS SL.
These conditions will apply with no prejudice to the application of whichever legal norms that may apply in each individual case.
The General Contracting conditions regulate the distance-selling relationship between BELLART CARDOS SL and the user or client in accordance with legal stipulations, in particular Law 7/1998 of April 13th, concerning General Contracting Conditions, Law 3/2014 of March 27th that modifies the consolidated text of the General Law for the Protection of Consumers and Users, Organic Law 15/1999 of December 13th on the Protection of Personal Data, Law 7/1996 of January 15th on Retail Commerce, and Law 34/2002 of July 11th on Information Society Services and E-Commerce.
BELLART CARDOS SL reserves the right to carry out any modifications it deems appropriate, with no prior notification, to the General Conditions. BELLART CARDOS SL further reserves the right to apply certain Special Contract Conditions that take priority over these General Conditions in specific cases, and to do so when they deem suitable, announcing them at an appropriate time and in an appropriate manner.
2.Information prior to booking
BELLART CARDOS SL informs its users that they can access the terms of use on the web site itself.
Through their booking with BELLART CARDOS SL on its web site users or clients expressly state that they are aware of, understand and accept those terms of use and the General Conditions. In the same way users declare to be of legal age and that they have the necessary legal capacity to access web sites owned by BELLART CARDOS SL and to carry out contracting procedures through the same.
Once the booking is finalised, users will see the booking confirmation on screen and be able to print this as a proof of booking.
The booking confirmation and the booking receipt will not be valid as an invoice.
3.Booking offers and price reference
BELLART CARDOS SL reserves the right to remove, repost or change offers made available to its clients through the web page simply by changing their content. This way, products and/or services on offer at any time through the web page pertaining to BELLART CARDOS SL will always be governed by the current General Conditions. The company also reserves the right to stop offering, without prior notification and at any time, access to the products and/or services mentioned.
4 .Price reference
Every possible booking on offer will have a price reference and state whether VAT or any other tax that may be applicable in each case is included. The prices given on screen will be the current prices at any time except in cases of typing errors.
5. Availability
The availability of offers that BELLART CARDOS SL promotes through its web page may change depending on client demand. Even if BELLART CARDOS SL updates its database periodically, a booking requested by a client may not be available. In such cases, BELLART CARDOS SL will send an e-mail to the client stating that the offer is not available.
6.Payment methods
When a reservation is made through the web page, BELLART CARDOS SL will request credit card information and the name of the person booking in order to charge 20% of the total booking cost and guarantee the reservation. This will be done through our ‘Virtual Point-of-Sale’ platform. This is a system for secure payment, VERIFIED BY VISA, that processes the result of the operation in real time and where communication is protected though a protocol for encrypting information over the Internet: ‘Secure Socket Layers’ (SSL).
The balance payment for the reservation is paid in person on arrival, in cash or by credit card.
7.Cancellation policy
If you wish to cancel a confirmed booking you must do so in writing to the e-mail address [email protected] or by fax to +34 933104155.
Depending on when the booking is cancelled, a percentage of the initial sum paid may be refunded:- Cancellations more than 60 days before arrival: 100% of the initial sum paid will be refunded.
– Cancellations between 30 and 60 days before arrival: 50% of the initial sum paid will be refunded.
– If the cancellation is made less than 30 days before arrival no refund will be made. If the client changes the arrival and departure dates it will count as a new booking and this cancellation policy will be applied.
8.Rules behavior
Users/guests are responsible not only for their own actions, but also for the actions of every person staying in the APARTMENT and should keep the following rules in mind:- It is not permitted to move bikes up and down stairs or in lifts, nor it is permitted to leave them in the apartment or in public spaces.
– No activities are permitted that may affect normal coexistence with neighbours.
– You are obliged to respect hours of rest and there must be no noise in the apartment or in public spaces between 10 pm and 9 am.
– It is strictly forbidden for more guests than stated on the booking to stay in the apartment. If this would be the case, your contract will be terminated immediately and no compensation made.
– Pets are not allowed.
9. Information for the processing of personal data
BELLART CARDOS S.L. is the Controller of the personal data provided with your consent and informs you that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and the Organic Law 3/2018 of 5 December (LOPDGDD), for the purpose of maintaining a commercial relationship (by legitimate interest of the controller, art. 6.1.f GDPR) storing them for no longer than is necessary to maintain the purpose of the processing or for as long as there are legal prescriptions dictating their custody. The data will not be disclosed to third parties, unless legally obliged to do so. In addition, you are informed that you can exercise at any time your right of access, rectification, portability and erasure of your data and those of limitation and objection to their processing by contacting BELLART CARDOS S.L. at C/Argenteria, 6 – 08003 Barcelona (Barcelona). 10.Applicable laws and jurisdiction
BELLART CARDOS SL also reserves the right to instigate civil or penal actions it deems appropriate in cases of fraudulent use of the web page and its contents, or for failure to comply with these conditions.
The relationship between user and service provider will be governed by current laws applied within Spanish territory. Should any controversy arise between the parties they can submit their conflicts to arbitration or turn to normal jurisdiction fulfilling rules with regards to jurisdiction and competence
